O'Malley prefers 2-license system for Maryland

ANNAPOLIS (AP) — Aides to Gov. Martin O'Malley say he prefers House of Delegates legislation that would set up a two-license system for Maryland, but would also sign a Senate bill that denies licenses to illegal immigrants.

In the House of Delegates bill, illegal immigrants would not be able to get new Maryland IDs after the law takes effect. Those who already have Maryland IDs, however, could renew their licenses and receive cards that would look different from other licenses and couldn't be used to board planes or enter federal buildings.

O'Malley spokesman Shaun Adamec said the governor believes "there are legitimate arguments for either bill," but he sees the House version "as a more practical, reasonable solution."

Maryland is one of four states that issues licenses to illegal immigrants.

Shouldn't it be considered aiding and abetting if our state knowingly gives illegal aliens a "special identification card" that allows them to remain in our state?

If a cop pulls over someone and they show this "special" license, shouldn't they be able to call ICE immediately? Or do we just come to the realization that Maryland is a sanctuary state for illegals?

If this "special" license will show the person is an illegal alien and ICE would automatically be called, I have no problem with that. As long as illegal aliens continue to be deported.

Dear Friends:

Annapolis is filled with love! Of course, as I have said before, love in all of the wrong places. Illegal aliens are receiving their usual share of strong support for drivers' licenses from the same old cast of characters.

The Judiciary Committee Chairman, Joe Vallario, and his allies, at the last minute, cleverly cobbled together a phony driver's license bill that promoted amnesty for the 212,000 illegals in our state who presently possess Maryland drivers' licenses. The original bill that entered Vallario's committee was clean and did not have amnesty language. The bill was de-constructed and transformed into the present version which passed the House of Delegates by a vote of 77 to 60.

More than 60 members of the House, including myself, who were co-sponsors of the original, honest piece of legislation, removed themselves from the corrupted bill. It was an historic Friday evening on March 27th witnessing all of these legislators standing up on the floor and publicly announcing their desire to remove their names. The two primary sponsors, one a Republican and one a Democrat, became so disgusted with the process that they also removed their names.

The Senate passed a clean and honest version that complied with the federal REAL ID requirements and contained no amnesty language. This bill passed by a 36 to 11 count.

Now, both pieces of legislation must come before a conference committee consisting of members from both the House and the Senate that will determine its fate. Mike Miller, the President of the Maryland Senate, is strongly opposed to the amnesty version. The Governor has announced that he support the two-tiered legislation that contains amnesty language.

There are two possible political outcomes. A clean, honest and effective bill barring drivers' licenses for illegal aliens could emerge and pass. Frankly, if the Governor signs this type of bill, he will proclaim victory and characterize himself as a leader fighting against the burdens created by illegal aliens. This would put quite a campaign feather in his cap.

The other option would be an amnesty bill which the Governor, expressing his true love for illegal aliens, would sign into law. Politically, that decision would be costly to him.

As you can see, things are very fluid. Anything would happen in the final days of the Maryland General Asylum. The session ends on Monday, April 13th. Should time permit, I will provide you with an update and, perhaps, a list of the conference committee members' names.

I worked very hard on the floor of the House, speaking on several occasions to my fellow legislators about the serious problems created by driver's licenses for illegal aliens. My bill last year, The Voter Protection Act, would have prevented illegals from receiving voter information and from registering to vote with their driver's license application. The amnesty bill, which I oppose, will continue the illegal aliens voter fraud problem. As you know, I have been helping to lead the fight in Maryland against benefits for illegals and the taxes they impose on our system. I will continue those efforts in the future.

House, Senate prepare to debate driver's license bills

ANNAPOLIS -

The House of Delegates and the Senate are headed for a showdown over how to bring Maryland driver's licenses into compliance with Real ID, a federal law that requires applicants to document their legal status in the country.

The chambers' differences boil down to one key issue: what to do with immigrants who received Maryland licenses under the old rules but do not meet the stricter requirements.

The House passed a bill last week that would allow those drivers to renew their licenses without the documentation. However, these new licenses could not be used for federal purposes or airline travel.

New applicants would have to meet the stricter standards, for which they would receive a federally-approved license.

The Senate, on the other hand, passed its own bill Monday that would require documented lawful presence in order to get a license.

The final legislation is expected to be hashed out in a conference committee next week. Gov. Martin O'Malley has said he will sign either bill, although he has indicated that he favors the House version, calling it "a more practical and reasonable solution," said Shaun Adamec, a spokesman.

The Real ID Act was signed into law by then-President Bush in 2005 as part of an emergency supplemental appropriations bill that funded operations in Iraq and Afghanistan, as well as relief for victims of the tsunami in Asia.

It went into effect in May 2008, but states were granted extensions until December 31, 2009. States meeting certain benchmarks can apply for an additional extension to May 11, 2011, according to the U.S. Department of Homeland Security.

Maryland is one of only four states that have yet to meet the standards, along with Hawaii, New Mexico and Washington. Currently, the Maryland Motor Vehicle Administration requires that applicants provide documents to prove Maryland residence and proof of identity, which can be done via a passport or birth certificate.

The House passed its version of the bill last week by a 77-60 vote, approving amendments offered in the Judiciary Committee by Delegate Kathleen Dumais, D-Montgomery, that would "grandfather" in those who currently hold a license but do not have the documents to meet the new standards.

Dumais said the House bill consolidated five separate bills and tightened their language to directly address the Real ID statute. The amended bill clearly defines "lawful status" and what must be used to prove it, she said, while the Senate version used "lawful presence," which is not a legally defined term.

"For what it's worth, we did a lot of work," she said.

Judiciary Committee Chairman Joseph Vallario Jr., D-Prince George's, found the bill an appropriate compromise that would allow those who had licenses to maintain the privilege they had already acquired. He cited the example of an adult who had arrived as an undocumented 2-year-old and was already established in job and family, both of which would be severely disrupted if he lost his driver's license.

On the House floor, several Republican delegates voted "no" after approving the bill in committee, including Delegate J. B. Jennings, R-Baltimore County. Jennings said he felt he had been misled to believe that the Motor Vehicle Administration supported the "two-tier legislation," when in fact it had not taken a position on it.

Sen. E. J. Pipkin, R-Caroline, voted for the Senate bill, which passed 36-11.

"Right now, we have vanloads of people coming from New Jersey and other states to come into Maryland every day. They go in through our MVA, they get a driver's license, and then they go back to New Jersey and swap it for a New Jersey license," he said.

Immigrant advocacy groups saw the competing bills in rather different terms.

"The House version is only barely more acceptable than the Senate's," said Kim Propeack, director of community organizing and political action for CASA of Maryland.

Propeack said at least 150,000 people in Maryland will lose their licenses if the Senate version of the bill becomes law. Undocumented children who have yet to reach legal driving age are "going to be sunk under either proposal," she said.

She said others possibly affected by the legislation include victims of natural catastrophes like Hurricane Katrina.

Sen. Brian Frosh, D-Montgomery, and chairman of the Judicial Proceedings Committee, voted in favor of the Senate version but said the future of both bills was uncertain.

"I'm not sure what will happen, but whatever happens will happen next week," he said.

Delegate Henry Heller, D-Montgomery, agreed.

"That's going to be a hell of a conference committee," he said.

As many as 350,000 licensed Maryland drivers might soon face a seemingly impossible choice that could upend daily life for their families and gum up the gears of the local economy: Stop driving or get behind the wheel illegally.

They're illegal immigrants but not illegal drivers. They've been carrying licenses endorsed by Maryland governors and lawmakers for years, thanks to policies shaped with a sensitivity to newcomers and a belief that state-certified drivers are safer drivers. But the General Assembly is shifting course to comply with a federal security law that requires states to issue licenses only to lawful residents.

Lawmakers are debating whether undocumented immigrants who have licenses should lose them or be eligible for a second-tier driving permit that would prevent them from boarding commercial flights or entering federal buildings. Gov. Martin O'Malley (D) has said he will sign either a bill that keeps them in the system or stops it entirely.

Either way, as soon as June 1, illegal immigrants in Maryland will likely face new obstacles in their ability to move around, a change with implications for motorists across the region. Since 2006, the state has processed about 350,000 licenses for drivers using foreign documents without U.S. visa stamps. Supporters of the change say the security of Maryland's license, which has been vulnerable to widespread fraud, is their overarching concern.

As the debate in Annapolis has trickled out through word of mouth and Spanish-language media, a sense of alarm and anxiety has spread to immigrant motorists.

"I work from 8 to 5:30, and then I have to rush to get to class," said Beatriz Aleman, 18, a Prince George's County resident who works by day as a cashier at a carwash and studies in the evenings at Prince George's Community College. "If I lose my license, how will I get around?"

Her father, Antonio Aleman, said he, his wife and his brother are in the same predicament: adapted to a highly-mobile American lifestyle that doesn't require legal residency but doesn't really work without wheels. "Why do they want to take our licenses away?" he fretted. Undocumented families would continue to have access to health care and public education.

Like all of the undocumented immigrants interviewed for this report, Aleman said he would probably continue driving even if he couldn't renew his license -- a scenario he was loath to imagine. "If I have to drive around without insurance, it's dangerous for me as well as other people on the roads," said Aleman, who drives a truck for his job as a metalworker.

If an accident or fender-bender can set the deportation process into motion after an arrest for driving without a license, many drivers will choose to flee the scene, he and others predicted.

Once, a license was just a permit to drive, issued until the late 1970s on a piece of paper. In the 1980s, photos were pasted on laminated cards. Since the attacks of Sept. 11, 2001, that permit has become the country's primary identity document. It's produced with all the security features of a credit card -- digital holograms, microprinting and other invisible features designed to ferret out fraud. Even the crab on the upper right corner of Maryland's license is secured.

In 46 states, it also is an immigration tool that separates legal from illegal, visible from underground.

Immigrant advocates say drivers without licenses and insurance who get into accidents will drive up insurance costs for everyone, and those who don't receive the training that is part of the licensing process might be more prone to accidents.

Motor Vehicle Administrator John Kuo said his agency has to weigh competing missions of security and road safety. "We said the security issue outweighs the benefit of safety."

The ability to drive has allowed immigrants to broaden their housing and job prospects.

Many Hispanic immigrants are employed in construction and landscaping, jobs that often take them to construction sites and new subdivisions beyond the reach of the region's public transportation network.

"How would I get to work? I drive all over the region," said Rey Juarez, 33, a Greenbelt resident who came from Guatemala eight years ago and works as a carpet installer.

Juarez's vehicle, a black 2007 Cadillac Escalade, had become a source of pride and status. "I could never have this in my own country," he said.

Immigrant rights advocates say the MVA could fashion a driving permit to look almost like a full-fledged license. But Kuo said that to avoid confusion, the card will likely have this phrase stripped across it: "Not for federal identification purposes."

Frederick is the only Maryland county that has deputized police officers to act as immigration agents, checking and turning over to federal authorities the names of illegal immigrants arrested for anything from traffic infractions to violent crimes. In recent months, Montgomery County police have started forwarding the names of suspects arrested only for violent crimes.

Police Chief J. Thomas Manger said he is conflicted about whether denying undocumented immigrants licenses is a good thing. "We need to do something to stop the fraud," he said. "But I don't think public safety is enhanced in any way if you have people driving without licenses."

An illegal immigrant caught driving without a license would be charged, "but we will continue our policy of not asking people about their legal status," Manger said.

Virginia stopped issuing licenses to illegal immigrants in 2004. The result, said Manger, who retired as Fairfax County police chief that year, was a mix of unlicensed driving and fraudulently obtained Maryland licenses. That year Virginia courts convicted 49,124 people of driving without a license, a number that had jumped to 62,642 by fiscal year 2007 and dipped last year to 54,282, statistics compiled by the Department of Motor Vehicles show. The numbers do not distinguish between legal and illegal drivers. However, Manger said that few charged with driving without a license have never been licensed in Virginia.

The prospect of a second-tier license makes many immigrants balk. The process would effectively create a database of Maryland's illegal immigrants, they said, that could facilitate federal immigration efforts to deport them in the future.

"That's discrimination," said Rudy Galvez, 26, a Guatemalan who lives in Langley Park and works for a sprinkler and fire protection services company. "I'd rather not have anything."

But others said many would apply for the permit, if grudgingly. "In the end, people want to drive," said Victor Illescas, 43, a Guatemalan immigrant who manages a garage at an Exxon Station in Silver Spring. "They don't care about entering federal buildings."

Must make some pretty good bucks installing carpet, eh Rey? An American saddled with paying rent/mortgage, multiple insurances (auto, health), utilities, food, clothing, taxes couldn't save enough to even afford a Cadillac, much less an SUV.

well,, when you don't pay taxes, when you get free health care at any ER and simply say "i'm illegal, i don't have money", and walk out without paying a dime, you have lots of extra money to spend.

i read that since maryland is now becoming a sanctuary state, and since so many illegals are flocking to us for our easy-access licenses, the average "legal" taxpaying household pays an extra $1,200 per year to make up for the difference that illegals don't pay.

Fraudsters Target Maryland For Driver's Licenses

Ever since the Sept. 11, 2001, attacks, more and more states have been restricting driver's licenses for illegal immigrants. But in Hawaii, Washington, New Mexico and Maryland, immigrants can still get a license no matter their legal status.

And because Maryland is the only state east of the Rocky Mountains with this more lax law, it's become an enormous target for fraud.

For several years now, Maryland's Motor Vehicle Administration has had to cope with a flood of dubious applicants.

"They would come in truckloads; there'd be pickup trucks that would have seven, eight, nine people in the back," says Sue Payne of Maryland Citizens First, which opposes licenses for illegal immigrants.

To document how bad the fraud is, Payne took to staking out MVA parking lots in the early morning hours, armed with her camera.

"They'd jump out of the pickup truck, the guy would come back, and we'd see the same truck coming all night long," Payne says. "And they were none of them tagged in Maryland. They were Virginia plates. We had New Jersey plates. We had Massachusetts plates, New York plates, Illinois plates, Missouri, Texas."

The long lines created havoc. So Maryland's motor vehicle administrator, John Kuo, started scheduling appointments with a special phone number for the high volume of foreign applicants.

"The first day that we actually rolled out the separate toll-free line for out-of-country appointment system, the telephone company actually contacted us and said, 'Something's not right here, because you're getting about over a million hits on your toll-free system,' " Kuo says.

The calls were coming from across the country. So the MVA restricted the number. Now, when people outside Maryland try to call for an appointment, they get a recording that says: "We're sorry. You have dialed a number which cannot be reached from your calling area."

Businesses Charge Hundreds For Help With Licenses

But the more sophisticated Maryland's anti-fraud effort has become, the more sophisticated its antagonists are.

The pages of local Spanish language newspapers are full of ads offering help in obtaining a Maryland driver's license. Kim Propeack, of CASA of Maryland, says a host of companies have cropped up, and they charge hundreds of dollars, depending on the service

"You can hire a company to get you an appointment; you can hire a company to help you translate; you can hire a company to do a bunch of these types of activities," Propeack says. "We believe that these companies have been real vectors of fraud."

Propeack supports licenses for Maryland's undocumented immigrants. But she suspects these license assistance companies are helping out-of-state applicants set up fake residencies.

In fact, state officials have found dozens of applicants using the same address. Propeack wants the state to go after these businesses.

But Kuo, the MVA administrator, says his agency has its hands full investigating hundreds of individual applicants a year.

"It's a very serious resource issue for us," Kuo says. "We only have a small unit that's dedicated to investigating fraud issues — it's only a unit of basically five individuals. And they are overloaded with fraud cases to investigate right now."

States Don't Recognize Maryland Licenses

For the third year in a row, Maryland Republican Delegate Ron George has introduced legislation to deny driver's licenses to illegal immigrants, and lawmakers are considering a ban again.

George says it's even more vital now. Other states are beginning to comply with a federal law called Real ID that mandates stricter requirements for driver's licenses. That means Marylanders find their licenses weakened.

"Maryland driver's licenses currently are not recognized in states such as Arizona, Colorado, South Carolina, Oklahoma, because they know that we do not seek lawful presence," George says.

If Maryland does pass a ban, it wouldn't take effect for a few months. And that could cause an even bigger rush as immigrants across the region seek a driver's license before the cutoff.

But Kuo isn't worried. He says the state's overloaded appointment system is booked solid for months. Last-minute scammers would likely be out of luck.

WE'VE SAID before that it makes little sense to deprive illegal immigrants of drivers licenses: It only will encourage more people to drive without proper training or insurance, endangering everyone. At the same time, as other states have tightened their laws, Maryland reportedly has become a magnet for illegal immigrants seeking licenses. This is unacceptable, too, given the possibilities of fraud and abuse. The Maryland General Assembly is wrestling with this dilemma.

To comply with a federal law known as Real ID, which requires stricter identification for boarding a plane or entering a federal building, Maryland has to change its law. The state Senate passed a bill that would prevent all undocumented immigrants from obtaining licenses; the House passed a bill that would do the same but would allow immigrants who already have licenses to keep them and, when those licenses expire, replace them with a second-tier document that would allow driving but not qualify as federal ID. The House bill, which has Gov. Martin J. O'Malley's (D) support, is preferable.

Some Marylanders may respond: Well, then, let them go back where they came from. But most of the more than 250,000 immigrants in the state illegally aren't likely to go away anytime soon. Take away their licenses and they're likely to continue driving, only illegally. Unlicensed drivers are responsible for a disproportionate number of accidents and fatalities. That's one reason that many law enforcement groups support the House bill.

Both bills would close the loophole that has turned Maryland into a magnet for identification fraud. As The Post's Lisa Rein and N.C. Aizenman reported, Maryland is the only state east of the Mississippi that doesn't check the immigration status of applicants for driver's licenses. A utility bill or bank statement is enough to prove residency. The legislation would tighten those requirements and curtail the ID cons.

Some conservative lawmakers assert that the House bill provides what amounts to amnesty for illegal immigrants. But the limited ID would not allow its holders to board planes or enjoy any benefits of citizenship or permanent residency; we think the state should make it available not just to current license holders.

This is another instance in which federal failure to fix immigration laws leaves state and local governments without good solutions. The House has come up with a less-bad alternative than the Senate's.

Man guilty of raping 11-year-old
30-year-old 'boyfriend' faces prison time, deportation

The 11-year-old girl thought she had a boyfriend.

That boy, however, was 30 years old and interested only in sex.

Danilo Ramirez, an undocumented immigrant from El Salvador living in Annapolis, pleaded guilty Friday to second-degree rape as part of a plea agreement with the state. He was ordered to serve 18 months in a county jail, after which federal immigration officials plan to deport him.

"I accept that I am guilty," Ramirez told the court through a translator before apologizing to his victim's family. "I am sorry."

Assistant State's Attorney Pamela Alban said Ramirez had sex with the girl twice in late October and early November. She said Ramirez would knock on the door of the girl's Annapolis home late at night while her father was asleep, the girl would let him in, and the two would have sex in the living room.

"She believed she was in a relationship," Alban said, explaining Ramirez did not physically force himself on the girl.

The relationship ended after someone told the girl's father what was happening. The father - who has four other daughters - called city police, who in turn investigated and arrested Ramirez on Nov. 28.

Alban said the girl knew Ramirez was 30 and that Ramirez knew the girl was 11. She added the girl was both mentally and physically scarred by what happened.

"She's actually having ramifications from this relationship," she said.

The father told the court his daughter spent eight days in the hospital and he was so upset by what happened he lost feeling in his face for two months.

"My entire family has been affected by what this man has done," the Annapolis man wrote in a letter that was in turn translated by city police. He went on to ask the court for a lengthy sentence.

"This man should not be released from jail or stay in this country so he can do this to another family," he wrote.

Assistant Public Defender Ginina Stevenson, Ramirez's attorney, said her client has a son in El Salvador. She said he came to Maryland so he could better financially support his son.

Circuit Court Judge Paul A. Hackner sentenced Ramirez to 20 years in prison, but suspended all but 18 months to be served at a county jail. Upon Ramirez's release, Hackner expected him to be deported.

If Ramirez returns to the United States illegally, he could face another 18 years in prison, Hackner said.

"He knows he cannot come back here," Stevenson said.

If I can have these things, I will contact the many people I know in MD (I grew up there). These are people who arn't active in politics and will recoil from such a task of calling politicians if the facts arn't clear as day from standard MSM sources and the method of involvement is not clear cut. This would take a bit of effort on the part of help save maryland members, but this would be effort rewarded exponentially if done well, because we need concise information to contact our friends in MD with

MARYLAND: State license compromise called unlikely

ANNAPOLIS, MD. (AP) — The president of the Maryland Senate says he doesn't see much opportunity for compromise as lawmakers consider whether to allow illegal immigrants any access to driver's licenses.

Both the House of Delegates and the Senate have voted to stop giving licenses to illegal immigrants this year. The House, however, wants to allow illegal immigrants who already have state identification to renew their licenses and receive a distinct card that could not be used to board planes or enter federal buildings.

Senate President Thomas V. Mike Miller said Wednesday he doesn't see a compromise emerging, and either he or Speaker of the House Michael Busch will have to "turn the votes" in their chambers.
